Electronic Communications Monitoring and Non-Privacy Policy
1. Introduction and Scope
This Electronic Communications Monitoring and Non-Privacy Policy ("Policy") governs all electronic communications conducted with or through the systems of Castro Residential (the "Company"). This Policy applies universally to all forms of electronic communication, including, but not limited to:
Email: All internal and external emails sent to or from any Company email address.
Text/SMS: All text messages (SMS and MMS) sent to or from any Company-issued or Company-managed device or number.
Voice Communications: All telephone calls, VoIP calls, and any other form of voice communication (including voicemail and recorded conference calls) made to or from Company phone numbers or systems.
2. No Expectation of Privacy
BY UTILIZING ANY OF THE COMPANY'S ELECTRONIC COMMUNICATION CHANNELS, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE NO REASONABLE EXPECTATION OF PRIVACY IN ANY COMMUNICATION, DATA, OR INFORMATION TRANSMITTED OR STORED THEREIN.
All communications sent, received, or stored using Company systems, devices, or accounts are the property of the Company and are subject to immediate, continuous, and comprehensive monitoring, interception, recording, retention, review, and disclosure by the Company, its agents, or authorized third parties, without prior notice or further consent.
This waiver applies to the content of the communication, metadata (including sender, recipient, time, location, and duration), and any attachments or files exchanged.
3. Purpose of Monitoring and Data Usage
The Company monitors and reviews communications solely for legitimate business, security, and operational purposes, including:
Quality Assurance & Training: To evaluate the quality of service, improve operational efficiency, and provide training to personnel.
Compliance: To ensure adherence to internal policies, regulatory requirements, contractual obligations, and applicable laws.
Security & Audit: To protect Company assets, detect fraud, investigate security incidents, and conduct internal audits.
Legal Processes: To preserve evidence for, or respond to, legal inquiries, litigation, or regulatory requests.
System Maintenance: To ensure the proper functioning and maintenance of all Company communication systems.
4. Limitation on Sale of Information
Notwithstanding the extensive monitoring and review processes outlined above, Castro Residential explicitly warrants that it will NOT sell, rent, or trade the content or metadata of these electronic communications to any third parties for marketing or advertising purposes.
Data may be shared with necessary third-party service providers (e.g., cloud storage, call recording services, e-discovery vendors) solely for the operational purposes detailed in Section 3.
5. Data Retention
Communications and associated data will be retained for a period determined by the Company's internal record retention schedule, which is set based on business needs, tax, and legal requirements. Upon expiration of the retention period, the data will be securely disposed of in accordance with Company procedure.
6. Consent
Any individual engaging in electronic communication with the Company via email, text, or voice channels is deemed to have read, understood, and consented to the terms of this Policy. If you do not agree to these terms, you must refrain from using these electronic communication methods with the Company.
